The only route you would have is proving that the tree is causing damage to the wall (actionable nuisance and the LA would have to consider that).

 

Apart from that, there's no right to light. Birds are migrant and may roost somewhere else next year. Once the leaves have fallen from the tree, its not the tree owners responsibility. I have seen hundreds of these letters, and most LA's will have policies that they will direct you to.

 

Also they are unlikely to go with the idea of felling a large (I'm guessing its large) street tree with high amenity and public value. With a replacement (guessing a small tree) in the neighbours back garden! It'll take years before anyone sees it and wont have the same public value as a street tree.

Might get him around, but the client will receive little sympathy for her issues when he realises he's there under false pretenses.

 

But if the wall IS being lifted then TO, highways and legal bods would need to be involved - of course a photo would help as we can't picture the extent of the "lifting"

 

TO will probably like to keep it

Highways will probably want it gone

Legal bods - well - they'll take instructions from whoever has most clout.

Opening post says that the next door neighbours wall is 'begging to be lifted', not is being lifted.

 

Light structure damage would introduce a whole new perspective.

Hope your charging for your advice, otherwise you might be better off putting your energy elsewhere. I don't think you've missed anything from what you can do but this is a battle that could last years that your now stuck in the middle of. As soon as she gets a response from the council your her first call.
