Should be getting paid holiday pay???

Im struggling I'm 23 this year and have load of things i want to go off and do learn to drive, go abroad for the first time, move out. I'm still living like i was when i was 17.

My boss knows about my troubles with the bank and ive had to borrow money from family just to do my tickets he wanted me to do and expects me to do the same so i can drive for him wit out any pay increase from him.

 

Is he bigger than you? I have some advice!

 

So did your earnings for the year fall below the tax threshold? Waht is it now anyway 5K? Something like that. You need to get another job mate!

Not wishing to harp on on the tax issue, but quite a few years ago, I was working for a firm (not arb) receiving payslips showing NI and tax deductions. when I moved on and they'd tied to sort my tax code, it transpired that the tax I'd been deducted had not been passed on to the Tax man. Luckily I had kept the payslips for the period I was there, or I'd have had a nightmare to prove my case. It turned out the boss had never paid in the tax for 20 odd employees! The rogue.

Back on your case I would go to Citizens Advice, they'll push you in the right direction. Good luck.:001_smile:

Although he doesn't have to give you a contract, it would have been in his interest that he did. Someone else talked about statutory entitlements. What he should have done by now - and he's broken the law if he hasn't - is give you written articles of employment, which is a statement which (I think) includes hours of work, duties, etc. You are entitled to holiday pay, as well as statutory sick pay and paid paternity leave, I should think.

I feel for you mate:sad: I would Get advice as said in other posts, try finding another part time job and working for him for a while and look for something better so you still have money coming in, Or just jump in the deep end and take a job abroard and enjoy life.

Your classed as part time i would say now they have just the same right as someone working full time you r entitled to holidays and all of the above post, I've had nothing but bad luck with employers (BUt thats another story) thats why im going self employed (and to spend lots of time with my kids which im loving)

I agree with all points raised so far.

 

I get "full & part" time but what about casual employed labour (as opposed to self employed as needed labour)? This does sound like a casual labour type agreement (its agreed cos you still turn up to work when he asks) but normaly that attracts better rates just like temping to cover bad times & paying your own holidays. Oh that reminds me temps get paid holidays now to from the agency.

You have next to no chance of gettign any holidya pay for the last 12 months, anything before that has gone now anyway.

 

I suggest getting things sorted for the future and if that means leaving then do so. Don't get too tied up fighting over what has already been and gone.

yeah he expects me to be about every day if he needs me, I didn't get a chance to contact citizens advice today as he called me at 1:30 wanting me to help with some decking (he said he would call me in the morning after dropping his car in to be fixed *muggins me was left waiting not being able to start any thing no knowing when to expect the call*).

 

I know whats already gone last year with holiday pay is gone and i wont get it back, but hopefully with help from citizens advice i can get that all going asap.

I'll have all day tomorrow to do this now through my mistake of telling him a better way to do a job that now does not need my help.:sad:
