top handles on ebay

am sure this question has been asked before but couldn't find anything via searching....i'm looking to possibly selling my 200t on ebay, where do I stand liability wise selling it to someone without seeing their nptc ticket? from the amount of these saws for sale on ebay it would be appear people are selling them freely.

Sold mine on ebay . Never had any come backs as it was working perfectly . I think it is not your responsibility once you have sold it . I don't think it is an actual legal requirement to see any tickets . Some dealers require it but that is their choice . :001_smile:

Would be good to know the exact legalities of a potentially dodgy situation. If mr smith, who you sold your saw to, seriously hurts himself or someone else, when would the HSE or a solicitor step in and ask questions as to where the chainsaw, that requires a certain level of qualification to purchase, come from and end up in the hands of someone unqualified to use that type of saw? presumably our details as the primary purchaser are linked via the serial number of the saw, which would mean we'd be easily traceable.

as far as I know there are no restrictions on selling rear handled saws, anyone can stroll into b&q and buy one, but I wonder where the goal posts sit with equipment that requires proof of a particular competence in order to purchase?

Is it a legal requirement that you hold a ticket to buy a top handle? Or simply down to the shop what it requires?, im thinking if it is law then you wouldn't be able to sell them to anyone who dosnt have a ticket, rather like buying a second hand shotgun/rifle

What happened is the HSE noticed avoidable accidents with top handled saws.

 

The HSE likes industry to regulate itself because that's cheaper and less fuss than making legislation so they made a few noises about a potential ban on top handled saws, the industry got together and agreed to instruct their dealers to insist on seeing a competency cert before selling a top handled saw

 

Private punters can sell them without such restrictions

So the original buyer, even if a business/professional user - which presumably 99% are, is still classed as a private seller? I'm probably complicating things, but think the sale would include vat etc and be entered into the accounts. Not that I actually disagree with what you're saying.

Its about who signed up to the agreement with the HSE.

 

The manufacturers signed up to it, no one else did (or were asked to).

 

No one else can be bound by an agreement signed between 2 other parties.
