Working on TPO's

I heard that they had made the fine unlimited now to try and hit building companies harder, as what is a £20,000 fine to a builder with a multimillion pound development? Often they will just absorb the cost of the fine, there may even be some that would budget for a fine for felling protected trees!

 

But LA's will now fine them and make them replant in exactly the same spot.

like everyone says check and dont take the homeowners word for it, the fines can get hefty, big problem for councils is they dont have the time to follow a lot up and get the pykies who did the work. However if a building/developer removes a tpo'd tree and rebuilds they will pursue that because the charge is on the land and then becomes related to sale price of said property. However in reality most people seem to get away with just a telling off.

What's wrong with your LA? They should 'Play Ball' and besides DDD trees and D/Wood are exempt form the application process. Just record what you are doing or removing with pictures/photos. Sound's like your TO is hard work.

 

To be fair they have improved, last AO was extremely efficient at telling people they had to remove there DDD tree's or the council would come along and do it but wanted applications putting in for simple deadwooding CL over highway footpath and removing DDD.

I know you can exempt them and provide proof etc but do you really want the LA on your case in the future?

 

Anyhow the latest guy seems fairly reasonable although not had to deal with them much lately.

 

I fully back TPO's on the right tree's in the right place's, its a pity that you cant get on a LA list where they know your standard of work so you could just go ahead with basic works and just inform them rather than have to fill in 3 maps and all the bumpf.

 

Would also be nice if all the TPO's where listed on the interweb, a quick search and you know what's involved or not.

Every contractor, good or bad, needs to apply for basic works and that is for many a good reason.

 

Get to know your AO and life will become a lot easier as long as he/she is happy with the standard of your work and your commitment to the cause.

 

No LA can ask for 3 copies since the latest amendments to the TPO bible. Print off copies of the new forms and carry them with you at all times.

It can be up to £20,000 per tree. LA can also claim back legal costs and offender may have to pay for replacement trees....

No, in severe cases I think the punishment can be fine and imprisonment as its a criminal offence to take down a TPO tree.
