It was through paypal and not ebay

 

If it is an ebay purchase, make a formal complaint that the goods are not as described and therefore want your money back and state that the owner knew the saw was shot as he agreed to pay for an aftermarket cylinder and piston.

 

Ebay is strong on protecting the buyer!

 

 

Bugger, just read the post again - guess it was an out of ebay deal?

Can you not do a Paypal claim? Here's their help page which specifically refers to non Ebay purchases. Got to be worth a try, surely.

Alternatively, if paid by credit card (via Paypal), then you could try a chargeback claim on the credit card.

I said that to him but he said he has no money till he gets paid, but paypal will refund me "no they won't " I am really peeeeeeeed off about this I've asked for his address to return it and I'm going through paypal to get my money back, and he's been ignoring me

Is his address not on the paypal transaction?

 

Don't send it back before paypal notify you to do so either.

Start a claim, give as much evidence as possible, they also can look at past messages through ebay even if you have deleted them. They will freeze the money in his paypal account, if not enough in there they will send it into the red. This will cause him huge problems if he has anything to pay out of it. If they find in your favour they will take the money from his paypal account and the linked bank account, if still not enough credit they leave his paypal account in minus and send nasty letters.

I had a problem this year where an item was not as described and the seller would not reply to my messages so I contacted ebay. They told me to wait a week to see if he would reply with a return address then I received a message from ebay saying they were refunding me and I could keep the item (it was a tablecloth which was round not square so was no use to us)
