Height of neighbour trees

I doubt the LA enforced a reduction on a Copper Beech. They have no powers to do so.

 

If the trees (there needs to be more than one and they need to be contiguous) are evergreen there is scope to use the High Hedge legislation. Once you have followed the correct procedure you can pay a fee and ask the LA to determine an action height.

well they did enforce it remember it well with the neighbours asking my mum and dad if it was them who had reported the size of the tree becoming a problem, as much as i agree it needed a reduction like it does again now as my house now receives no light either due to the size of the tree, it is a beautiful tree just a shame its in such a bad spot really.

 

As well as which they were told if the tree work was not undertaken then council contractors would do it and then the bill would be placed on the address, there by if anyone was to buy the house in order to complete the sale the bill would have to be paid first.

 

dont know if anyone else has heard of this happening?

Might not be relevant or possibly outdated, but we were told on the RFS cert 7 or 8 years ago about the Prescription Act which states something along the lines of: while you have no right to a view you do have a right to light.

 

Anyone know anything about this? Was a long time ago and details are a bit fuzzy.

They haven’t enforced it have they? If they have reported it the way it happened, it sounds like someone has been bluffed.

 

The enforcement you cite with the invoice sum becoming a land charge is to the best of my knowledge only possible if the works were done under the miscellaneous provisions act. Misc prov requires the tree to be imminently dangerous and couldn’t be used for “intrusion”.

 

The laws on trespass are common law and are civil. The LA has no powers to act on that issue and normally run a mile.

 

The only other option for enforcement is under the HH laws and a single Beech tree isn’t a candidate for the HH laws.

just spoke to my mum about it and i am slighlty mistaken with my post she says it was firstly to do with height over the pavement and then it turned into 'well lets reduce the tree abit while we are at it'
