i think that deserves a bag of burning pooh on the front doorstep for that bit of work

in fact id go so far as to invite you to squat down on his front lawn the morning after a good curry.

You have to live next door to this guy for years to come, don't get involved in any petty arguments, it's not worth it.

 

Go round and knock his door, with a bottle of wine in hand. Say "Hi, I'm Jason, your new neighbour. There seems to have been a bit of an misunderstanding on my part, and I realise now how much of an inconvenience that acer must have been. My wife makes a mean lamb rogan josh, would you like to come over for dinner this Saturday, as a way of us apologising to you?"

 

Then when he comes over, chuck a few yew berries in his curry. I reckon 4-6 should shut the bastard up for good.

I think it is pretty clear that your neighbour is in the wrong having cut branches on your side of the boundary.  However the chances of you winning a case are pretty slim and there is no point in falling out with him.  Also the damage is done now.  I would simply make sure the neighbour is made aware of the law in this situation and politely say that if the tree doesn't recover, it would be appreciated if he would replace it like for like.

 

Still if he declines, replace the tree yourself and move on.

The problem is you are now aware you have an arsehole of a neighbour.  You could play the fun game of, see whos a bigger arsehole. If it doesnt cost him,  he will do it again, or worse.

 

He has gone well past the boundry with that, although it wouldnt have looked too good, he has gone too far.

 

The law on boundry trees says they can cut, but they cant force you to pay for the cut or to take back any waste.

I'd be chucking it back over, speared into his lawn in a circle and leave a turd in the centre.

It's hard to put a price on good neighbourly relations, but I'm pretty sure they are worth more than the price of even a decent sized replacement tree. Saying that, it seems that ship has already sailed, given this outrageous, shitty thing that the neighbour has done to your tree, on your property. To say nothing of the butcherery involved. Nasty, angry little man. I'd be seething.

 

What did he say in the way of justification for what he did, out of interest? I can't imagine there's anything that would make sense to most people.

 

I suspect there was some history around this issue of a few leaves from a beautiful tree.
