Can you legally use someone else's equipment?

Hello just wondering if someone else is able to use my climbing equipment?  I don't see an issue with it given my consent, however i recall when i was being trained up that an instructor said that under a certain board you cant use another climbers gear.

Technically the first P in PPE is Personal.

 

I'm very selective about who i let use my kit. Firstly I have to know they're competent and responsible. Secondly I have to know they can afford to replace whatever I lend them.

A while ago there was a US tree firm owner lent his rope to crew, then it snapped on him when he next used it. In wheelchair. Said he always ran his rope through his hands before ascending, except on that fateful day

From the HSE website:

"The Personal Protective Equipment at Work Regulations place duties on employers to ensure that PPE is:

• properly assessed before use to make sure it is fit for purpose
• maintained and stored properly
• provided with instructions on how to use it safely
• used correctly by workers"

Legally, as long as those key points are checked by each use of the PPE then they're good to go. However, you could raise the question of 'how can I confirm that so-and-so maintained, stored and used this kit properly?' if ever in doubt, don't share.
