He couldn't have fallen to the ground if he has another line on. So a couple of things he could have done to reduce the chance of this happen. Check his gear functions before climbing and use another rope.

The car anology doesn't make to much sense. It's very much our problem to check things that involve our safety.

The design is very similar to some other makes. 
It does come down to checking your gear regularly, and making sure that it is working correctly when in use.
I had a similar issue with a triple lock / 3 way carabiner on a lanyard. It was operator error as I got it caught in my top.

I've had 2 or 3 of these exact snaps and had the same issue a couple of times in about 10 years use of them. When the bit of metal slid under the other i felt the resistance and just pushed it out and carried on. A bit like when your normal 3 way carabiners don't twist locked when closed cos of sap or whatever, you just twist them locked and carry on. 

Then later that day I contemplate buying shiny new stuff.

Never thought of writing to the manufacturers to complain about my lack of maintenance on the kit they sold me.
