It would be interesting to find out how many LAs have actually taken a contravention to court in the last few years. I know that my local authority hasn't in at least the last five, despite have bomb proof cases with enough evidence to secure a successful conclusion.

Its like timber extraction Gary . Sometimes the cost is more than its worth ..

i wish we could people more passionate about the young trees than some over mature sticks, although this tree was obviously in its prime

 

Problem is that young trees often fall into the C category on development sites, so don't enjoy much protection anyway. If the replanting plans were better and not full of Sorbus and Prunus that would be a start.

well the tree in question is not native to the British Isles.....plant some oaks or whatever in its place

But if there is no punishment for contraventions, the whole system becomes flawed and becomes pointless. 

 

One case that I know about, where a tree was felled after an application to fell was refused and a contractor was caught in the act, wasn't prosecuted even after the TO threatened to resign. 

 

It doesn't encourage anyone to abide by the legislation and just encourages all the fly by nights that we all complain about.

Totally agree bud , totally, but it is what it is  . Bring back the grease nipple and you would not have to fit a new part every time one failed

Should we really be so focused on what is and isn't 'native' or, in preparation for climate change, present and expected future pathogenic threats be looking to increase species diversity wherever we can?

Don't be so fatalistic Stubby, With that attitude we might as well scrap TPOs and CAs (think of the money that could be saved) and make it a free for all.

 

My argument is to push for a change in legislation, any money from fines should be kept local and used towards replacing/improving the amenity that has been lost.

 

I can't remember where or who was behind it, but one of the American states used to have a scheme(still might) where if the home owner wanted to remove a tree from the front of the property, they paid into a fund which was ring fenced for new highways planting. 

 

Currently the system doesn't appear to be working, so maybe it's time to change things?
