Maybe he had the wedges at one side of the cut or the stem had heavy lean, or maybe just more decayed at one side of the hinge? See guys rocking stems by hand all the time, always makes me cringe!

Like the Banks say - we work on zero risk.

Where there are significant targets we always use secured offset tag lines, then if the unexpected happens at least the stem will at worst follow the predetermined fall line arc.

If you demonstrate you follow best practise, a piece of paper doesn't mean much. But proving you did ain't easy ( hence the damage ) plus no insurance cover if yr negligent- straight out of yr pocket . Does sound like it was an honest accident- but you may have to prove that too. K

Rocking it on the hinge would not be best practice, maybe he could say he had his flip line attached, then surely Cs39 would cover him, not best practice though ??

Blame the Banks in the end-they underwrite insurance company,  want to minimise their losses and insist insurance companies show due diligence on claim management IE competent contractor doing job right. Is why we do manual handling courses now with empty boxes so that employer insurance won't be paying out fr bad backs. Or whiplash claims fr car insurance. It's a tricky path. K
