who is responsible for clearing up the leaves that fall from from trees my neighbours leaves always seem to finish up on my garden . i dont even have any trees .can this be classed as littering by the neighbours as the arent taking reasonable care to dispose of leaves..

For them to clear them up they would have to come onto your property so this is unlikley! I guess you would have to clear them up but you could give them back to your neighbour, for them to dispose of them.

 

You could take this to the extrem and just throw them back over the fence/boundary but do you really want to casue friction with neighbours?

 

It can't be classed as "littering" because leaves are a natural product, in no way can they be considered litter!! In the same way as an apple core thrown on a verge is not littter.

 

Just get on with clearing them up. I'm sure you wash your car and hoover the carpet.

Common law states that 'leaves are like cats and are free to go wherever the wind may blow them' or something like that. In effect, I think once they have landed in your garden they are yours and therefore your responsibility to clear up and dispose of. if you chuck em over the fence you would technically be littering.

unfortunately it's up to you to clear them up, as has already been stated the tree owner has no control over where they drop and as such cannot be classed as a nuisance (in the legal sense)

Leaves (or is it leafs?) shouldn't be classed as a nuisance in any sense. They are a natural occurance and no difference to the dog malting, the carpet getting dirty, the bins needign emptying then fence painting etc etc.

We have a serial complainer in Worcester who lives near one of our parks. Every year he complains to us, even the local papers about the noise created by the blower. He’s insisting we rake the whole park by hand!!

Echo do a 'quiet ' blower, designed for sensitive areas like hospitals etc. Might be worth a look .
