Take a dictaphone, be clear concise and polite. See if you can catch them out on a recording.

 

So what is the "catch them out" referring to? I agree that, if they claim harassment, a recording could be useful evidence but as I said, it would be inadmissable evidence in a Small Claims court, which is a civil, not a criminal, court. In other words, if you don't tell them they are being recorded, they could make a full admission of attempting to rip Martyn off and the court could not allow it to be admitted as evidence. I stand by my advice that Martyn should seek qualified legal advice, preferrably through a pro bono arrangement, and proceed from there.

That would make you feel better but will not get you your money!.

 

Minimise your loss, legal action, time, etc etc will cost you more than the job, Dean will say it is on principle and he would be right. You have to decide if you being right and proving it is worth more than the Job.

 

Personally I think you are best giving them a final notice in writing stating you will pass the matter over to a debt collector or small claims hoping he will cough up, make sure you state the facts. If you don't get a response send another letter advising you will be taking action and decide then if you walk away or talk it further.

 

At the end of the day it is business and business is money. Take the emotion out of it and learn from this even though it will leave a bad taste in your mouth for a while.

 

Good luck with whatever the out come is.

Dont take this the wrong way but what really really annoys me is this "infringemnet this" "infringemnet that".

 

Take for example CCTV, there was a huge resistance to town centre cctv by these so called "do gooders your infringing on our privacy pratts", and they said the same thing about that. It couldn't be used in a court of law because the image ios digital so could be digitally altered.

 

Yet CCTV has been an absolute godsend and has helped to solve thousands of serious crime that would have otherwise gone unsolved and helped to reduce violence in town centers no end.

 

You stick to your belief that it will be infringing upon the rights of whoever is the other half of the recorded conversation and I'll carry on recording anything and everything and see who comes out better off :biggrin:

 

I have a recorder on my phone that records every phone conversation because a large advertising company ended up trying to take me to court becaue they said I verbally agreed to something, had I not had the recorder I would have lost or had to pay half

I never said it was my personal belief that rights were being infringed, I said it was inadmissable as evidence in Small Claims court as it was infringement in the eyes of the law:biggrin:

Not read all post but we have a works order and payment agreement that we use for clients, this will hold up if you want to go the legel way, just means you have a signed agreement that they agree to the written quote and will pay with in the agreed time.

 

Would be glad to send this to you just in case they is a next time

 

Would say they got a bloody cheap job was it 3 men for a day, they are taking the p!!!!!!!! trying to get you to do the extra. I do agree if all other avenues fail then logs and chipping on the drive works.

We pay for a service here that takes up matters like this.

 

It costs about £350 per year and gives you 90% of the bill up front.It may mean you lose 10% off the cost of a job that won't pay.However compared to leagle cost's and time spent on chasing money,I think it is a bargin.
