need help with customer..refuses to pay.

Are they sayign that the other trees are in the original quote? If so where are they getting that idea from?

 

Do they want a quote for the other trees, so that when thye are done they will pay the whole bill?

 

I like the waste dumping idea the best, I have always thought that that would be what i would do if in the same situation.

I Have only been in business for 2 years so i am new to all the legal side of things.

 

i prefer to deal with things in an old skool way.

 

How do you mean, old skool? Knock some of his teeth out? Break his fingers one by one? :laugh1: I know it's probably what you feel like doing, but unfortunately it looks like getting a lawyer/small claims court involved is the only way you'll see any money.........and even then I'll be suprised if you get all of it. Big pile of logs dumped on his driveway is always good though.....

It's does work turned up with 3 truck loads of chip and wood before and they payed straight away:001_smile:

I am writing in regards to the outstanding Payment of £380 For work completed on the 24/09/09.

 

I have completed all the work that is written on quote

 

I have sent a contractor out to do any work that we may have missed.

 

 

To my understanding you would like to pay me to sum of £260. I can not accept this as I will not make any profit from the work completed.

 

Please note that the quotation is a legal document and i shall only carry out the work that is written on it.

 

If you would like more tree work carried out I can give you another quote for this work at a fair price.

 

Please pay in full before the 14/11/09 or I shall issue a county court claim against you.

I had this once. Customer(a busness) knocked me outright with a smile on his face, he works on his own on a saturday so I turn up, walk into entrance and left an invoice for a load of chippings, with an apology for late delivery on his counter as he was not going to come down the stairs from his office. anyway out I go and start tipping,before the load slipped out, he was head out his window pleading me to stop ,and he paid ,wrong or right I got my money.

legaly speaking the waste remains the customers until they have paid for what you have done / quoted to do.

i would inform customer of this in writing giving them a date on which you will be returning it or requiring payment before this date .

keep a copy for yourself .

you cant get any fairer than that

MArtyn-- You should state the date(or number) of the quote. i.e. "I have completed all the work that is written on quote dated(numbered) XYZ.

 

That way it is specific which quote you are refering too. I trust you have copies of the quote and that it was sent to them in an un-alterable format?

Yeah i have copy. I have edited a little to make it more professional.

did a slabbing job a month ago, customer wanted the price keeping low so we agreed to use all soil in some raised beds. rang her at lunch to say there was too much soil and did she want me to take some away, i'd do it for the price of the diesel. no, she says, keep piling it up, i'll sort it.

 

rang me later that night, very happy with the slabs, but she's not paying as theres too much soil, and its not good enough quality!!!!!!!

no matter what i offered, she wasn't interested in listening, didn't want me back on site, not paying, i'm picking on her as she's on her own!!!!!

thats fine, don't pay a penny, was my reply,

are you sure she said

yeah, i'm new to area and trying to get a good reputation, so if she's THAT unhappy, i'll send the lads round in the morning and take it all up.

No, no. can we come to a compromise, was her answer

 

the upshot of this is.

when i now get a job accepted, i take a job sheet with me, with the job described in full, price, what we're doing, what, if anything the customer is doing, and before work starts, the sheet gets signed by the customer.

no arguments then.

 

I watched a tv programme not long ago called "cowboy customers" you cant take anything you put down on the garden, as soon as you put it on the property it belongs to the client, they went into the legal loop hole that exists there were a few horror stories of guys doing extensions,drives etc and client not paying and they went back to lift the materials and got CHARGED for theft and vandalism, not many of us would not go back but it was an eye opener to think the law was on there side.

 

i am sure that letter will do it martyn.
