All trees within a conservation area that are above 75mm diameter at 1.5 etres above ground level are automatically protected as though they are covered by a tree preservation order and the penalties are the same as for contravening a tree preservation order. The notification procedures for doing works to trees in a conservation area are different than for a full tree preservation order,

hedges do not apply to conservation areas, they come under high hedges act part of the ASBO thing. A hedge is classed as a row of two or more trees maintained regularly as a hedge so you can claim a row of trees never prunned is a hedge. this is what ive been lead to belive.

My take on this is hedge cutting/reduction/coppicing is USUALLY exempt from con area regs, but I normally just inform the T/O in case he gets any queries from the "concerned public". Only takes a couple of minutes to do, and then if someone tries to kick off, you just say its cleared with the council.

The council only have the option to put a TPO on any tree you notify them that you are going to do work on.

 

If you think they may put TPOs on any of the trees in the hedge then tell them,as Big A says its only a call,if you know the T/O,but i know that if i rang the two T/Os of the areas i work in most to ask about a hedge they would think i was loosing it.

 

But each area is different and so are T/Os.

 

Fruit trees are exempt.
