wood burning stove

confused,

three years ago I installed a defra approved stove, in a smokeless zone, and had the work signed off by the council planning dept.

Now have a letter from the council environmental heath dept saying 'it has been reported to them, by a neighbour, that I am burning logs.' They go on to state that as I live in a smokeless zone I can only burn fuel off the approved list, needless to say logs aren't on the list! They state that if I continue they will consider prosecuting me!

Before I ring them I wondered if anyone can advise me?

There's your problem, conflict of authority!

DEFRA is central government, council is local government. It's not unusual for one to have no idea what the other is doing.

Check that your woodburning kit doesn't invalidate the DEFRA approval. If it doesn't, ring them and tell them (nicely but factually) that they're wrong.

If it does, tread carefully!

It's more than likely a standard letter,

Seasoned wood in an approved burner is all pukka, if the LA don't know or chose to work around that let them dig a hole, then fill it in on top of them.

Ignore the letter and if they come back to you, invite them to investigate the matter properly and maybe bring a warrant with them. :laugh1:
