ebays a joke

bought a graham edwards tipping trailer on ebay lastnite, only for the joker to back out after the sale was over, no reserve on it

Left some negative feedback, at the end of the day it isnt worth the hassle chasing him, ebays a commission collecting agency and as long as they collect their commission from him they will be happy.

maybe but its also a legally binding contract, as mentioned all over the place in small print, so i would chase ebay, i dare say you wont get the trailer, but ebay will cause him some agro

 

I fell out with someone that pulled a listing a few mins before the end, and i was high bidder, and he must of realised he wasnt going to get what he wanted, he was a plant dealer and had about £30k's worth of kit on there and ebay closed his account :thumbup1::lol: didnt get me the tractor but will have caused him some agro :lol:

You have a legally binding contract with the seller at the auction's end and, unless they pulled out before the auction ended or a reserve was not met, they are obliged to sell to you at the agreed price. If they sell to someone else, you are entitled to either find another trailer to buy and sue them for the difference or, if the trailer is a "special" or one-off, you can obtain a decree of specific performance which forces the sale through. Worth mentioning this to the guy and seeing what he does. The only exception would be if the item belonged to a third-party and the seller held no title on it, leaving the sale voidable or void, depending on whether the issue was mistake or fraud.

what i can never understand is people who put in their description "listed elsewhere"

whats that supposed to mean? do they not understand that once its on ebay, thats where it has to be sold?

 

what wasnt said either, got him on the phone earlier today, just said he personal problems all week, i supose that means he was goin to pull it if he was had got near his computer.

 

there were 2 ending at same time wish i had bid for the other tipping trailer, not to worry maybe pick 1 up soon

THe good thing about ebay is that there is a clear electronic paper trail to back your assertions. If it were me I would tell him that unless he produces the trailer for your winning bid price you will action the matter in the county court. My experience is that a letter from a solicitor along these lines nearly always produces results without the need to actually go to court. Depends how badly you want the trailer.

Not before anybody has bidded for it. It's just a load of pictures on a page until then. You can edit descriptions and such too, but once someone has bidded it's carved in stone so to speak.

 

Unless it's changed. It's been a while since I sold stuff on eBay.

hi i buy and sell loads on ebay

 

make sure you report him to ebay as they will still charge him the final price fee which works out at about 10% of the final value up to a max of £40, so he will gets stuck with the fees and wont be able to relist for free,

 

i know it wont help you but at least it will make him think twice about doing the same again.
