That legislation is for rear markers and tape it doesn't apply to me, I ALWAYS work facing INTO oncoming traffice, so marking the rear of the vehicle would be a waste of time

 

Unless I'm mistaken, isnt parking facing oncoming traffic against the Highway Code and Ch8 regulations? If your vehicle is on the highway to carry out any work, should you not have out signing/lighting/guarding to Ch8 requirements?

your correct andy , highways have the right to close down any site not complying with street works etc and if they see fit they can serve an on the spot fine, also if you set out your own traffic management equipment then all opperatives must be qualified to do so ahd there must be an appointed supervisor (qualified) that does not have any input in the setting out of TM equipment .

Hahaha, I bet there isn't one single street in the country where someone hasn't parked facing the wrong way outside their house :001_smile:

 

It's a bit like the speeding laws, and the used dipped headlights when raining laws, nobody abides by them

I know, I'm being pedantic! BUT if, God forbid, someone is injured or worse around your vehicle/worksite, the Police and HSE will have a field day with you

...and just to add, whoever says in CH8 or whatever Legislation that we as arborists should work feeding a chipper with traffic approaching from the rear want shooting.

 

I made my own rule up never to work at the back of a vehicle with the hopper facing traffic for good reason. I was sick of people knocking cones and coming into the work area .

 

I face the landrover into traffic for our protection, otherwise you have nothing but a traffic cone to save your legs from being amputated at the knee

Are you sure about this? I have a contract direct with highways and they only asked a minimun of one operative on each gang and a superviser who doesn't necessarily need to be on site.

one operative is acceptable but it means only that one operative can set the TM out and your correct the supervisor does not need to be on site but must be able to get to the site within a reasonable time scale .

 

With regards to using one qualified operative and 3 blokes that are not qualified means that should one of them are injured or killed whilst setting the the site out then the site foreman will the one primarily responsible . also should there be a Road traffic accident of a serious nature it would be highly likely that both the police accident investigators and the highways agency would investigate the site taking into account the TM ste up and its possible implications to the accident . i personally would not want to take the risk but if you can get it in wrighting form your local highways office that they feel its acceptable to work in that way then i would .
