as long as he/she do their own accounts and fund their self employment/business, do hmrc have issues with this:confused1:

Classed as your employee with all the associated paperwork.

My understanding is that in order to show you are self employed you would need to demonstrate that you are not working for one company. I think they give a percentage figure but would have to check on the HMRC site. I think they would take the view that if he is a sole trader working for you 5 days a week (or 100% of his working hours), then really he should be an employee.

They also look at the pattern of work. If somebody works for you the same days every week then they are a part-time employee as far as HMRC are concerned.

Just try and get other invoices through your books and don't state what days your working e.g 5 days work @£££ a day! For the

If they work solely for you then they are an employee and I have heard HMRC have requested back payment of taxes from the time the "self employed" person started working for the company.

Often wondered how bricklayers get away with being S/Employed , but work on site 5 days a week for same company , yet Arb related workers get pulled up for this ???

If you work 5 days a week for a company on a se basis then do your own job on a Saturday and issue an invoice at the end of the year you will have more than enough different invoices to go through!
