he is a subbie....... which means he isnt an employee which means he cant take me to a tribunal

 

 

There's been quite a lot in the news and reviews recently about zero hours contracts.

 

And there's always plenty of debate on here about what actually constitutes a "subby."

 

There seems to be a contradiction then. If he is a subby, you haven't sacked him, you're just not engaging his services any more.

 

So is he (a) a subby that you use once, twice, thrice a month, or is he (b) the bloke that comes with you every day, every week and doesn't have any other work streams but you call him a subby so as to avoid PAYE & employees liability insurance?

 

I hope it doesn't blow up on you!

Sorry David, I did completely understand why, just wanted it understood that I had referred to the OP using a term that required you to edit it.
