If he was a sole trader, I don't think EL would have helped him.

he needs to be sueing the guy he was working for + had he been using a 2,nd point off atachment ,he may not of fallen, looks like lack of experiance, he may even have cut his rope ,its a bit shy on facts surronding the incident !!

may be he thought the n/t was an easy cash cow,
