1970,s according to the owner of the tree. The tree is in the garden next door and was there before the house, which I am lead to believe has some bearing on the matter.

 

Indeed it does - the house would be built on a "shrunk" soil. Take the tree out and the soil reverts to its normal hydrology.

 

I would suggest that the owner seeks the advice of a structural engineer before instructing you to remove the tree.

Unless of course the Cherry was planted in ’76. If it was and you fell it, the house may fall down..lol

I would do it in one go aswell, cherry has shallow roots anyway and as has been said before i don't think there would be a prob with foundations on anything within the last 30 years or so.

I would do a little investigation and dig a small hole at the side of the house and see what you have. Half an hour or so may put your mind at rest

No need to dig anything Dean, the vast majority of Kent is chalk and flint.

The problem is say 6months to a year later the customer rings up blaming your work for causing foundation damage.

 

How can you prove otherwise were do you legally stand.
