Where does one stand with being contracted to carry out work on a neighbours tree(s)?

 

Just looking at a job and I think the neighbour may be a recluse?

 

I'm stating that I need written permission from the tree owner for access and to carry out the works, but if that can't be got, would I be ok with written permission from the neighbour who would be employing me? On the basis he has spoken with the owner / served notice possibly etc?

 

I'd be working off an independent survey, nothing immediately dangerous, just tall trees with a bit of maintenance work recommended that the neighbour is concerned about.

 

Or the alternative seems to be tell the tree owner, if no action and if something happens let the insurance companies fight it out, my customer wants to avoid that though.

It's your customers responsibility to get all permissions sorted. To go without permission is trespass, to do work without permission on neighbour's trees is an aggravated trespass with, possibly, criminal damage if my interpretation of the Criminal Justice and Public Order Act 1994 is correct.

May have been at home, but they didn't answer the door.

Yeah, not a big issue, it's fine as long as the permissions are gained, was just thinking it through in case they can't get the neighbour to put it in writing.
