All arborists need to know the law the links have been highlighted by other posters All arborists need to do sweeps for birds and bats and other protected species the reason for this is obvious to see what is there This when recorded provides the proof that reasonable care was taken to prevent any breaches in law You then can demonstrate that you have not behaved recklessly this is how the law has been strengthen You do not need to be a ecologist This is best practice There is nothing wrong with doing your own sweeps its a risk assessment

You need to do a dawn and dusk survey or a ecologist to do it day before and day of felling if you find birds flying into the tree with nest making material don't fell Law has been beefed up to include recklessness ie if you don't do what I have explained and be able to prove your in the poo I do bird and bat sweeps as a pre curser to all tree work this so if I end up in court again I have my records and diary notes to **** their barristers over and claim costs Usually police wildlife officer who will try to prosecute but usually the council have gathered evidence if you do something wrong make a no comment statement and don't think helping them that they will be fair with you Wildlife crime is serious and the judiciary want to be scene to be holding up the European directives and habitat regs Hope this helps
  4. British standards are a guide. They should never be anything more. BS5837 has caused more trees to be felled then any decay.This because to procure a survey costs more than often tree removal pre planning. Back to your point when i dig square holes to plant my trees I get all sorts of coments.|When I tell em that its to stop girdling roots no one believes me. Sometimes do it wrong is easier, does it matter on the majority of jobs. Its good your questoning but dont get hung up and purest. I make it in Devon Takes 48 hours Not cost effective unless u plan We chip anything upto 2.5 inches Anything above that that's straight is cut for charcoal and firewood We burn the bits we can't chop we don't use log splitters And roots go in the kilns Roots and big bits in middle as hottest part Only burn when weather dry rain cools kiln Wood needs to season for at least 6 months If u bring whisky saw and axe Do a days graft cutting for the kiln and i will teach u Only use hardwood or your customers won't come back Whisky is needed as there is much dust we prefer it to dust masks Shoot straight stay alive

I don't understand low emissions but I would have expected there to be an excemption for older trucks I run rb44 there all about 1991 4liter Perkins and 4x4 legal to carry 2.25 tons You will buy one with a chip box fitted for. £6k and it will have no more than 15000 miles on clock Brakes are in Stone Age or like a series 2 landrover

  13. UK legal precedent that ignorance of an offence is not a defence (it undoubtedly shows that you have been diligent and taken reasonable steps to act within the law, however). I dis agree with this statement. Under your human rights you have the right to a belief if you believe the iformation given to you then you are protected. to underpin this with the amount of legislation being passed these days it is very unlikely that one could keep up with new laws and coment upon them let alone judicaly challangeing them. hope this helps

Hi jack Learn the law it's the most important thing it's cost me more money than anything else Now I know the law I earn more money Now all the things I worked hard at to try and earn a living I do for fun and it pays Forget your tickets learn the law and the excemptions Work to a Agro forestry permaculture concept I now all this sounds weird but spend a day checking out what I have posted and life will be easy Good luck fella

  18. Did some felling in George Coles neighbours house a week a go it was bizarre we were stood on the road and George drove by in a green rover that looked like a jag with a trilby and camel coloured jacket. Made me feel old
  19. The stalking directive is pretty good As with this one you need to cherry pick but the advice is always sound as stupid comments get corrected by senior members or legal heads
  20. The timber under caravan and feed for my goats cows and turkeys in it slowed me down to 3 rd gear sorry if I slowed u up travelling from Bristol to small holding in Teignmouth sorry fella i got a lot of charcoal to make there this summer
