Trailer weights (again)

I transferred to an irish license when I moved over here, but carried what I already had which was 7.5t vehicle plus 4t trailer. A spectacular deal which I firmly intend to hang on to. Steve Burkitt, my boss at the time, god bless him ,told us all in the mid 1990's to urgently lose and renew our licences as legislation was about to come out removing the heavier weights from ordinary use.

Thank you steve if you read this for a trouble free life ( in many ways!!) since.

 

 

Steve Burkitt! There's a name fom the past. He and his crew used to subcontract to Gifford Tree Service when I was there, now and again. Would have been early to mid nineties.

We've probably met!

Yeah , him and kim Gifford used to pass work too each other as and when it suited. Did you ever do the paintball ( madness ) for the Christmas parties? There were two long haired redheads. Rob our main climber was one, I, the other, used to try to keep all the kit running, did most of the stump grinding, and all the matador work.

you CANNOT be prosecuted for a possible offence, only an ACTUAL one, otherwisw every vehicle driver in the UK would be charged with speeding as there vehicle was capable of exceeding the posted speed limit......same as the plate on an hgv trailer, shows what is the maximum it can carry, not what it actually IS carrying.......plod and DVSA will try and bullshit you, ask for a supervisor and proof in black and white on an official DoT document

 

That depends on which offence you are talking about.

 

If a post 97 licence holder has a trailer that is empty & weights 600kg but plated at 2000kg is towing it with a 2000kg MAM car he will be prosecuted for driving not in accordance of his licence. IE he has no licence for the vehicle combination he is driving. As its the plated weights that count.

 

If a pre 97 licence holder has a trailer plated at 2000kg but has a real weight inc load of 1000kg & is towing it with a car that is only allowed to tow 1100kg he would not be prosecuted for being over weight. As its the real weights that would count.

the law, as written down, is as

"If you passed your car driving test between 1 January 1997 and 18 January 2013, you can:

 

drive a car or van up to 3,500kg MAM towing a trailer of up to 750kg MAM

tow a trailer over 750kg MAM as long as the combined MAM of the trailer and towing vehicle is no more than 3,500kg"

MAM, is to be taken as the maximum gross weight, as I said before you cannot be prosecuted for NOT commiting an offense, irrespective of what plod or DVSA might think.....if it isn't written down in black and white on an actual act or statute......it dose'nt exist....

No quite sure the point you are trying to make as you have agreed that you could have a car & trailer that actually weights under 3500kg but has a MAM over 3500kg & you would get prosecuted.
