This was a different case and was in Cheshire, I think.

 

Courtesy of the 2012 Regs. all the old Regs. have been revoked. Also, the provisions in every existing TPO are cancelled except for the information necessary to give the orders legal effect and identify the trees protected, and replaced with provisions in the new regulations.

That would be my interpretation also. The relevant town and country planning act would be 1971 section 60, not sure about the regs though.

I Have had a reply from the council and turns out the tree in question was not included in the original tpo. The garden boundary has changed since the tpo was made which is why the address is shown to be within the area.

Fortunately this has been resolved easily enough, thanks again for the previous replies.

There you go, better to be safe in the knowledge that it isn't, than to wallop out the tree and find out it was!

Coincidentally I am looking at a case just now where 2 disputing neighbours are arguing about the age of a line of trees. I may be able to use my own method to estimate the age of the trees by measuring their diameter.
