So this is why I don't get as many jobs as I would like....

 

This was sent to me a couple of years ago from a large property management company.

 

 

Dear Sir/Madam,

 

 

 

I am writing to all contractors and suppliers in respect of the Bribery Act which came into force on 1st July 2011.

 

Firstly, I am aware that some contractors or suppliers offer our staff hospitality in some way or another, as a "thank you" for using them. This takes the form of tickets to events, food and drink etc. This is acceptable providing that the hospitality is proportionate, I.e. not excessive. Where offered and over the value of £20.00, all staff will have to arrange for a director to sign this off before accepting.

 

However, staff are not allowed to accept incentives, either cash or in another form, for work or contracts being placed with us. This is unacceptable as this constitutes a bribe. Where staff are offered such an incentive, we have told them to report this to a director immediately. The Bribery Act, which replaces existing legislation makes it a criminal offence both to offer and accept such incentives. As well as the individuals concerned, this can also apply to the companies involved.

 

Any contractor or supplier who we believe has made such an offer will be removed from our approved contractor list immediately and any existing contracts cancelled with immediate effect. Failure by our staff to report such an approach from a supplier will also be considered to be a disciplinary matter.

 

Any member of staff who is found to have suggested or accepted such an incentive will be subject to disciplinary action which may result in them being dismissed.

 

Also, whilst I do not believe that this is happening, if any member of our staff approaches you, or a member of your staff, and requests any form of incentive, then you should immediately advise us. This is vital because of the implications to us, as a business, and if we establish that this has occurred without being reported to us, then again we will remove the contractor from our approved list.

 

For any suggestion of a breach of the new Act, we will also report this to the police for investigation.
