May be repeating another post but "what about the case where a lad/company feeding a chipper was prosecuted under HSE regs for using a top handled saw for cutting awkward shaped branches etc,? although not in posession of the full facts-maybe someone can clarify this case and explain where the company/individual when wrong ??

Yes-but that surely is not "an offence" is it ?

 

Not per se but the HSE have said don't do it and they have the power to bring a prosecution under the HSAW act so while there is no specific law against using a top handled saw on the ground you can still be prosecuted for doing it.
