been looking at cabstars swell, there about 5k plus for a decent one. basically i put down a deposit on a merc sprinter pick up, was a minter, got a phone call this morning saying he has sold it so he refunded me my money, isnt the point of a deposit to save it for me?

Breach of contract, but is it worth the hassle? Basically, you had a contract to buy, he has breached the contract so you could take him to court and, if you won, either try for a decree of specific performance (to make him sell the original truck to you, which is unlikely if he has sold it to another) or for the difference in price if you can find a near identical vehicle to buy ( ie if it costs you 5k, you would aim to get the extra 1k from him). :001_smile:

In the ideal world, would it really be worth all the hassle?
