birds trees and employees

i am starting this thread as yesterday in work i felt under pressure to work on a tree where there was a nest and an egg in it! something felt weird when i threw the throw bag into the tree and hit a bird sending it flying out: when i got into the tree i came across the nest, i shouted down to work mates about the nest and what to do? personally i believe in karma and i want to go home at the end of the day without killing or breaking anything :001_smile:opinion was devided but i felt pressurised to carry on with the lift.

i covered the nest and carried on with the work doing my best to protect the nest and leave branch network covering it! I finished the lift and the egg and nest survived.

 

so after that waffle the questions running round my head were where do i stand as the climber? what and where can i find info on tree work and birds? what are my legal obligations? should i have carried out the work? if not how do i put it to my boss?

 

sorry if i sound stupid and appologise if i should know this however i now work for a company where as before i worked for myself and if there was a nest/eggs then i would leave the job and return when the nest had been flown:001_smile:

Hiya M8,

Do a search on Nesting Birds. This subject was covered in great depth two weeks ago on this forum, with over 50 replies (differences of opinion)

 

But in a nutshell birds and their nests are protected, even working in a tree with a "live" nest is illegal.

 

In the past, I've had the RSPCA drag me out of a tree, because a neighbour had telephoned to complain I was disturbing a pair of nesting crows!! At the time I was removing deadwood and storm damage from the other side of the canopy.

Its a diffcult one isnt it.I would not want to work in a tree with a nest in it at all.The wildlife act makes that clear. But i can see the dicotomy in it.Boss wants the job done which equals money..and how we all need it in this reccession ,but the legal duty is in your face.

 

Could the job have waited a few more weeks?
