How many Ash have to die?

Sorry, yes you're correct of course about the 3rd D re dying. But I do know many trees get removed before planning even gets notified of future developments, so if no TPO or Con Area is already in place there is little that can be done. I know of one oak in particular, where a drive is to be put in the future, and the tree is in the way. I have asked the TO to TPO it, but there is no imminent threat to it as the proposed drive has not had the plans put in yet. But I have been approached to remove the tree, I know there is imminent threat. The tree will eventually be removed before the plans go in, nothing I can do now.

 

The TO need to have his bumps felt then!

 

Is he aware of a threat? Yes, because you told him about it. Threats take many forms, planning applications being only one of these.

 

And the question to be asked is: is it expedient to protect the tree? If the tree meets all the other criteria then this is easily going to stand up to challenge.

hmm, obviously there are means of appealing against a tpo, but can you appeal against a decision NOT to serve a tpo? I'll have to have a look, unless someone already knows...

I do know the answer to this as it happens, having been involved in a very long process looking at precisely that issue.

 

No, you can't, other than by Judicial Review to look at the LPA's processes. There is no provision for it in the TPO legislation.

There are already unscrupulous people doing jobs like that though. Door knockers, cut your tree mrs? people.

 

I do see what you mean though and I reckon it'll happen along with a lot of panic requests to fell ash "incase they get the disease."

 

About two months ago I quoted a very old ash pollard just wanted lifting to let the light in and a few other things to do in the garden. I priced the job higher than normal as the job was out my area at £750 I didn't expect to get the job.

The next guy to come round kicked the bottom of the tree said it was dead and quoted 4k for a take down :001_rolleyes:

The customer is 101 years old! I hate it when people take advantage:thumbdown:

The tree was fine although I might get a call soon now. :001_smile:
