i posted this to maybe help others, ive opened myself and my friend up for critisim, if people are then going to start using this against him then i will have this thread totally removed, its shame that some people have to think like they do.......................

im not posting his name or ward or where he is or whatcompany he was working for now.....

but for those who are genuine i will pass on your ''get wells''

Vduben, nobody is criticizing you or your buddy, although it’s understandable for you to interpret it that way. You must be feeling absolutely gutted while at the same time pretty shaken up by the whole thing. Sincere apologies if perhaps some of our posts, mine especially, weren’t as sensitive as they might have been.

 

While there has also been some speculation about the legal implications of discussing the incident on this forum, at the end of the day you did not actually witness what happened so the content of this thread is just speculation.

 

Let us know more only if you feel comfortable in doing so. Take it easy vduben, and thanks for having the guts to share bad news as well as the good.

I really do not want to sound as an absolute bore on this interesting thread, but a very serious word of caution. Such cases and I have three running at this moment almost inevitably come to Court and therefore all these issues must be treated as sub judice at this stage if you do not want to damage the potential case of either the likely claimant or the likely defendant.

 

You will be aware that similar cases can involve mega bucks but if a Court/Judge thinks that a case or an expert witness has been pre-judged or influenced by prior discussion such as on this excellent forum then a case which may take years to come to Court can be ruined.

 

Please in the interests of all likely parties to a possible case or claim, do not therefore discuss this particular case in detail.

 

Please however may I add my concern to those that are suffering.

Most of the people using this forum are working at the sharp end of the industry.

 

I believe our safety should take precedent over any potential court case which may arise from this accident.

 

By discussing this accident and finding out exactly what happened, we could then make a point of implementing any new safety procedures which should apply straight away. Thus reducing the risk of the same thing happening to someone else.

Dang man, not to sound the ass myself. But accidents should be discussed openly and the information shared freely with those who may benefit from it, like the rest of us who cut trees. QUOTE]

 

Got to agree with you Squish, it takes guts to even post such a tragedy on a forum, knowing that some will criticise every thing thats done. But if it prevents just one fatality/serious injury, then it serves its purpose. We all like to post on the jobs that go well, and get the pat on the back from each other. But to have to post about a close friends accident is just the last thing any of us want to do. I think I can see where Colin B is coming from tho' , but I think that as long as company names etc arent mentioned, I dont see how the case in particular could be predjudiced.

Thanks once again vdub for posting this valuable thread, and please please keep us all updated on your friend.

Again no offense/fault was intended by any of my posts, just discussion. I could never for an instant claim to have practiced perfect work procedures. But I've been lucky and have learned and hope to continue being luck and always trying to learn more.

 

Atleast keep us updated as to how your buddy is coming along.
