beach tree conservation area

hi all first post will do a quick intro names paul own bydand tree services and have been in the buiness for 8 years self employed for two months now and well its slow but getting there based in north lanarkshire ok thats me love reading all you posts and advice very informative.

 

 

ok my question is i have just returned from looking at a tree in a conservation area the tree is a mature beech badly leaning over a drive and next to a public path client want it felled now i advised her it was a conservation area and that local planning would need to be notified the tree would need to be section felled due to location and size of garden any advice would be great first time having to deal with planning thanks in advance.

if its conservation area you just need to give 6 weeks notification of your intention to remove the tree, if the LPA has an issue with that then they will either come back to you and discuss a half way answer thats ok for you, your client, and them or if they are anally retentive they will slap a TPO on it if they want to protect it... or they may have no objections

Get on the council website that the tree is located in and find the application form for tpo and conservation area, fill it out i would phone up the local tree officer first tho say you would like to check a tree you no its in conservation area but want to no but has it got a tpo i dont no if its same for every council but here we need to fill out the forms then copy them and send in 2 identical forms its a ball ache of a process they will deside within 6weeks on arrival of application of there decision

No you don’t, you have to use the LA's paperwork for a TPO but a "211" can be in any form as long as it makes clear which tree and your intentions.

its the same form down here for tpos and conservation areas you just tick the box saying its for tpo or conservation area.

 

i no for applications they want 2 copies of the same form exactly written out the same think they should photocopy stuff them selfs personally but hey :thumbdown:

I never do 2 copes for TPO's and generally just send a short email for CA notifiatioins.

For a TPO you MUST use the paperwork, however for a conservation area notification you can write it on the back of an envelope as long as it meets the requirements.

it wouldnt meet the requirements for the tree officer at are council though he is a real t**t :thumbdown:

 

The requirements for a "211" are that they should clearly identify the tree, and any proposed works which boils down to a schedule of works and a map. As long as the notification is properly formatted they can’t refuse to accept it.
