" Abolition of the small trailer exemption

Paragraph 3 of Schedule 1 of the Goods Vehicle (Licensing of Operators) Act 1995 exempts from operator licensing a ‘small goods vehicle’ forming part of a vehicle combination (not being an articulated combination) where all the vehicles comprising the combination excluding any ‘small trailer’ have a plated weight not exceeding 3.5 tonnes.

A small trailer is defined under the Act as a trailer with an unladen weight not exceeding 1020kg. This trailer does not need to be included when calculating the 3.5 tonne limit.

However, under the Regulation all the vehicle combination (including any trailer) operating for hire or reward must be included when calculating the weight limit, so the small trailer exemption will be abolished for hire or reward operations from 4 December 2011. However, the small trailer exemption under paragraph 3 of schedule 1 of the Goods Vehicle (Licensing of Operators) Act 1995 will remain in place for operators carrying goods other than for hire or reward."

or is it just that most run trailers bigger that 1020kg?

 

 

The bold statement is good enough for me! Its my product be it fire wood or wood chip.:thumbup:

No a 4x4 will still be exempt as dual purpose. Your chip isn't for hire or reward its part of your work, your chipper cannot carry goods so is fine. The 1050kg unladen weight is for the purpose of the rules they have to set a figure you will still be able to tow it full as long as below the train weight of 7.5 tonne then different rules start. The agricultural/forestry exemptions will still apply but wait and see. For hire and reward seems to be if you carry other peoples goods (which most of us don't) such as furniture, parcels, someone elses horse etc. They are only changing the standard OL licence which most of us were exempt from anyway.

 

The disco 3 website has a letter from Vosa to Ifor Williams which explains a bit more i put a bit on here earlier.

 

This is the problem, vosa staff do not know then for certain, I asked him about 4x4 he said yep still applies, I hope you are right though.

You may be allowed to drive a minibus if it is not used for hire or reward. Hire or reward generally means any payment in cash or kind made by or on behalf of passengers that gives them right to be carried in a vehicle.

 

hire and reward means getting paid to take an item form A to B.......not using when to get to work

so on my qoutes if i write due to the manner in which i can recycle green virgin waste,all rubbish is to be taken away free of charge for my use.

 

and the presence of woodchipping material/equipment attached is for my ease of recycling for my own usage,

 

needs to be tested in court lol, any takers?
