hi everyone had a situation today was told i needed to complete a tpo form to remove a dead limb over footpath and road the tree is dead has a tpo on it though i gave council a courtesy call then had a long discussion \ row i stated was happy to prove by taking photo s or they could meet there .the lady stated it was up to them to say it was dead not me !anyway doing job tomorrow taking pics just to be sure. have i got the wrong end of the stick ? by the way tpo officer was off this was his line manager stance ... never normally have any issues with the council...

You cannot damage or kill a dead tree or branch, so they would struggle to prosecute you.

 

If it is dead, it falls under the 5 day notice rules (DDD) so just serve notice and carry on.

if the tree is dead and posing an iminent risk then as long as you can prove that the tree is dead and dangerous , i should add that this is always a gamble and the L/A may still try to take action against you . In my personall opinion they would be barking up the wron tree so to speak !!

thanks to all who replied i was just so taken a back at the lpa s attitude and manner perhaps the officer was having a bad day ?...there parting comment was dont forget the fine ! any need i thought ..
