Also inconsequentially to this thread, I changed the name of it to client psychology thread. Partially to get a rise out of Jules but mainly because it’s the right word. You sell goods to customers and services to clients.

You sell services and goods to customers, you sell advice to clients. Calling customers clients also just makes a contractor look like a bit of a twat

Good luck with that one, only the housing association have any contractual relationship with the contractor. It's debatable if you can claim any loss,   from tort, because you were not warned that the work was going to potentially damage your tree, but that would be with the HA (imo ianal).

Should have rephrased it sorry, I'll be contacting the HA and they can bring it up with their contractor

It’s a sycamore. It’ll fight back.

It’s just occurred to me that we’re talking about roots. Do they fight back in the same way above ground pruning causes new shoots? We don’t do a lot of root pruning in this country.

That changes things, if your selling!

Surveyor is unlikely to look at the roots as they will be well hidden, under dirt, in the neighbours garden!

However if the tree fails in the next couple of years there could be some come back if the purchaser didn't think you have disclosed everything they think you should have. If after that the tree is thriving then you could argue that any future failure was not due to grinding out some roots.

Next doors owner (HA) have made their path flat and smooth so might have been a tripping risk they had seen - better to do the job than defend legal action - so there might be something they can do to help if you want to remove the tree.
