Felling License and Conservation Area

Hi Guys, 

Been to look at a job today to fell a large amount of ash trees in a forest school that I believe I'll need to get a felling License for. I know the trees are also in a conservation area. Will I have to get the normal permission from the council and then apply for the license?? Or does the license take the conservation area into consideration?

Assuming you are in England....

2012 Regulations

15.—(1) Section 211(a) (preservation of trees in conservation areas) shall not apply to—
....

(b) the cutting down of a tree in accordance with a felling licence granted by the Forestry
Commissioners under Part II of the Forestry Act 1967 (Commissioners’ power to control
felling of trees);

So, applyfor and get license. FC should consult with Council.

Doing it the other way round is no use, CA consent is not exemption from requirement for license.

FC woodland officer here. 

 

Apply for your felling licence and declare conservation area. Your local WO will consult on your behalf. If LA fail to respond within 28 days we will take that as implied consent and issue a licence. 

 

If its a regeneration fell or clear fell of over 0.25ha consider woodland tree health grant (we will pay for restocking potentially)

 

Put as much information into the 'notes' section as you can think of. Helps us loads in making a decision and get to know the local WO. I quite enjoy a chat snd any excuse to get out on site and away from a computer is most welcome!
