Client ignores advice, who is liable?

A good friend of mine was killed when a roadside tree fell onto a car he was travelling in, so it’s quite an emotive subject for me.

 

People who don’t take responsibility for roadside trees they own get my back up to say the least.

 

I don’t think it’s unprofessional in the slightest to point them in the right direction.

You should re-read this thread from the top Jules, it’s nothing to do with sour grapes about losing one job.

Weigh up in your mind how you might feel about reading about that tree on the news where someone had been injured or worse.

I'll think the tree owner is a bad person, especially as he was warned by a tree professional.

I'm not sure what we're talking about any more. One has a duty at law to warn a tree owner of the risk. But one does not have a duty to report them to the authorities straight away for not giving one the work to deal with the tree.

What are you meaning by pointing them in the right direction? 

I too am annoyed at irresponsible owners. In teh past few years I have personally, acting as a member of the public, brought some killer trees to the attention of landowners. 30 metre high limes and beech with kretz or meripilus, might even have saved a life by doing so. 2 outside a school, 3 outside a nursery.  In all cases they did something about the trees, eventually.

Result then.

It’s not about me getting the work, I don’t always want or need it, but someone should do it if there is genuine risk.

 

The most dangerous roadside tree in our village, a sessile oak that would fall into the road/onto a house (it’s a co-dom) was highlighted by a Highways inspection 3 years ago.

 

I was asked to fell it by the Parish Council, but there was a note on the spreadsheet saying ‘ownership in dispute’.

Further enquiries revealed it actually belongs to Highways, who won’t speak to me because I’m not a ‘preferred contractor’.

Although it suits them when I’ve tidied up plenty of their shite in the past….

 

3 years on the tree is still there.

 

If it does fail badly someone will get their pants pulled down.

If the parish council were willing to pay for the work why not do it? What possible consequential cost to you would there be if it were dangerous?

 

Sorry to hear abut your friend killed by the dead (monolith?) at Runnymede, there was no excuse for leaving it standing.

This grew arms and legs! With respect to my original post, I advised the customer I’d only be willing to take both down (ash and elm) to just remove any chance of future issues. Heard nothing back 😂😅 thanks for the advice, and glad it generated some constructive discussion for the other chap. 
and with regards to Client/Customer. He was indeed a potential customer!  The difference had been noted!
