need help with customer..refuses to pay.

Hi There small claims is the way forward with that amount . I did a small claims some years ago for just a little more that amount it was not difficult to do and I won . Sometimes When the other other side receive there papers to attend court through the post they will settle out of court with you there and then if they they think they are going to loose .

 

Dont let them get away with it.!! You have done the work for them now you want your money .

Just remember to make sure you add on all the extra expense you have gone to, such as letters and court charges, but don't take the p*** with it or you won't get awarded costs.

Ok i got cheque through post for 260 today. ( not the 380 quoted )

 

They have also sent me letter saying until i trim the laurel hedge and reduce the willow i will not be payed full amount...NON OF THIS WAS ON THE QUOTE!

 

now i am thinking should i keep the cheque...and go give them a load of heavy timber on driveway.?

 

Or send it back and take them to small claims?

 

Knew someone who got acid put all over there bmw because they pissed someone off. ..gets me thinking!

Do it all legally mate. Go and see the CAB to double check the information I gave you re D & C Builders before cashing the cheque, then take them through the Small Claims court after the cheque clears. If you trash their car, who do you think will be first to get a knock on the door from the cops, plus I wouldn't be keen to hire a tradesman who behaved like that if I was a customer. The law is on your side so why put yourself on the wrong side of it?

I had a customer tell me he wasn't paying what I had billed him, he didn't think we should charge those prices, prices he agreed to. He was full of himself over the phone.

 

I told him I would be down knocking on his door in four minutes, which was just enough time for him to write a cheque.

 

He had the cheque there ready and waiting.

 

These people thrive on writing letter and being bolshy from a distance, bring the dispute to their front door. Call in every day on an evening at meal time and ask for your cheque, then step it up to twice a day, bring the dispute face to face, they will soon get fed up

Definitely a better plan than getting yourself done for criminal damage

me and my brother had same problem a few weeks back.with an adorable little old lady.we turned up she was nice as pie great ,tea ,coffee,food,half way through taking out top of conifer hedge,she wanted extra done so we discussed the extra and how much it would cost she changed into a nasty peice of work,she wasnt going to pay us(for extra or for the work we done)so we packed up told her that we were getting a solicitor involved,her son that evening phoned my brother threatening him,my brothers as cool as a cucumber,spoke to him saying that we want her to sign a contract that on completion of the hedge that we would get paid in full,they wouldnt do it so we told them we wanted £250 for doing half the hedge and if not a solicitor would be involed,they sent us a cheque for £125,that was for 3 of us a chipper disposale of waste..so we cut our losses .so i picked up the yellow pages and warned every tree surgery company & gardener in it to stay away from her:sneaky2:

You didn't need her to sign anything else as long as you had given her a written quotation detailing the work to be done and the price to be paid for it. In contract law, once the bargain has been made, both sides are legally bound unless they mutually agree to rescind.

NAH. I wouldn't try to hurt someone over it. i have learnt from acting like that in the past. gets you know where.

 

 

Can you tell me one thing though...if i call them everday to chase up payment ..is that harassment?

In my opinion, not if your quote clearly shows the work and price agreed, and you are reasonable over it. Obviously, if you start calling them late at night, or are aggressive or threatening then that would be viewed differently. If you are going to turn up in person, it would be worth having someone stay in the car with a clear view and within earshot in case they tried to claim misbehaviour on your part. As I said before, I would urge you to seek advice from a qualified person about any action you intend to take, as I can only give you my unqualified opinion.
