Hypothetical question re subbies.

I don't think you can just pass fines on to someone else... The council will pursue who they think is responsible or who they think they can punish..

 

What i mean is I would tell the guy im subbying too that he has to pay the fine. if he refuse then so be it but I would never work for him again.

The enforcement officer told me that the person who has the saw in his / her hands is the person who they will fine. Not the business owner. Not the tree owner. Not the supervisor.

 

Its not up to the enforcement officer. He is a flunky with little or no real authority, the grandly titled enforcement officers job is primarily to investigate and present his findings to decision makers, still they do like to stroke their own ego's

 

The ones with that authority would be the LA legal team and they base the decision on legal precedent.

 

The simple fact is that if you are an hourly paid employee with no decision making authority any prosecution will fall on its face. It would be moot and pointless because it would be punishing the wrong person and allow the perpetrator to go un punished. If that were the case an employer could simply offload the fine and any criminal record onto an employee.

Talking about a similar scenario the other day & couldn't come to a conclusion. But what if a new & inexperienced employee got given instructions but got it wrong & did the wrong tree.

Who gets the blame & potentially a fine?

He is a directly supervised worker, if he makes a mistake the problem lies with the level of supervision, particularly given that he was new
