  1. Dan. Correct. Their insurance is for their jobs not somebody else's jobs. This is another Arb myth and you have put it right.

  3. Actually I cant see the point of labour only subcontractors having their own insurance. Their insurance is for their own jobs not yours. If there was a potential claim the liability would be with the lead contractors and not fall at the door of any labour only subcontractors who work as employees.

  8. The minimum cost of Employers Liability cover is about £200 as a rule but this depends on what you do. Compared to the fine of up to £2500 per day its cheap!. And yes it is the law regardless of frequency. Further information can be found at. Tree Surgeon Insurance : TSINS

  10. Avoid Prosecution!! We have just heard of another Tree Surgeon who is in trouble for not having Employers Liability Insurance for his subcontractors. He was incorrectly told by another insurance company (and his mates) that he didn’t need this for his subcontractors. The reason given was that they were self-employed and had their own insurance. This is absolute RUBBISH and now this chap has found out the hard way. There is no grey area for your climbers or groundsmen. These people are not bona-fide subcontractors. If you use subcontractors to assist you and you don’t have Employers Liability Insurance then you are probably breaking the law. If you work as a climber or groundsman for a Tree Surgeon, then make sure your boss has Employers Liability Insurance - even if you are self-employed. Ask to see their certificate. It is your legal right. And if they ask you to have your own insurance then think very carefully about who you are working for. Employers Liability Insurance has been a legal requirement to cover labour-only subcontractors since 1969. And again I stress climbers and groundsmen fall into this category. Wake up and smell the coffee!

  14. If you have any body assisting you including self employed contractors or volunteers then the law is clear that you will need Employers Liability. The question is who is in charge as somebody needs the cover, I am happy to advise if you want to call 01732 373864 ask for Simon
  15. Recently we had an enquiry from somebody who was in ‘trouble’ with HSE over a minor accident. The guy did not have Employers Liability Insurance for his sub-contractors. It is with his solicitors at the moment but the simple fact is that his groundsman and other climber are not bonna -fide sub contractors. We could not offer cover because of the pending prosecution. We have banged on about this before but this story re-enforces the message. If you have self employed sub-contractors assisting you then it is extremely likely that you need to have Employers Liability Insurance. It makes no difference if they have their own cover. If it is your job then you’re in charge. And if you are in charge then you are in charge of everything including your sub-contractors and their safety. Make sure you have this cover and don’t listen to anybody who says you don’t need Employers Liability Insurance because they are self employed and they have their own insurance. They are wrong.   17. Pete, If you have someone helping you that is self employed then there is little doubt you need Employers Liability insurance. The law states this.   19. If you are subcontracting as a climber it is likely that you are covered under the lead contractors insurance. Even though you are self employed the law states it is very likely they need to cover you with Employers Liability Insurance and with this you will fall under their Public Liability Insurance
