How strict are VOSA on towing weights?

Ok so I got a reply.

 

Trailers of any type can not be mobile equipment as they are not self propelled.

 

You made reference to an O1/O2 "Firewood Processor" Trailer and whether or not such trailers would be deemed as "Mobile Machinery" for the purpose of IVA, thus gaining an exemption.

 

A vehicle defined as "Mobile Machinery" is not exempt from the requirements of EC Directive 2007/46 (The Framework Directive) but it's approval becomes "optional".

 

However, Mobile Machinery under this Directive is defined as;

"any self propelled vehicle which is designed and constructed specifically to perform work which, because of it's construction characteristics, is not suitable for carrying passengers or for transporting goods"

 

The key word here is "self-propelled" so in that respect, a Trailer would not be considered as Mobile Machinery by definition.

Not sure what the difference is in reality between exempt & optional?
