Birds nest in tree to be planted

A guy we do some work for ask this question today, he has several large root balled trees waiting to be planted as part of a contract and a bird has begun building a nest in one of them, what can he do, very little I would imagine.

 

I suggested (and this is only a suggestion which I made clear) he might be able to move it 2/3 metres a day until it was in position without the bird even knowing and not disturbing her.

If it has only "begun building a nest" I would take the "nest" out and carry on.

The bird will just go and find a new place to build.

without knowing what bird it is, this is not necessarily true, if for instance it was one of the pest species, and fouling from the area directly below was causing either a hazard to health or a slip hazard (guano when wet can cause injury) then he would have the right under pest control to remove it, even if it has eggs and or chicks in it

 

check out the "general licence" (google it) for a list of the pest species,

That exception is intended for use where birds are causing a health issue, using it in this situation would be a loophole and definitely not in the spirit of the legislation
