I went to look at this beech tree few days ago that was shared between 2 neighbours. The tree had been butchered before and the epicormic growth was unreal! Long story short I recomended it be dismantled, put a price in 1 neighbour was happy, he later went and told the other neighbour what I had said and told him the price. The neighbour said no no I've already got a tree surgeon coming! Anyway a lad turned up in shorts trainers ladders no shirt and a christmas cracker chainsaw and this was the end result! Looks like they had tried to put a gob in which was allover the place! The tree would never have gone where they wanted it to anyway! It would have flattened the wall and maybe even a passing car! Now I've gotta go and dismantle it and remove the mountain of brash that's been left behind!!!

Just think of all the people walking by who have seen your truck there and now think you're the one who was doing the tree

I personally think that the client is at fault who let this lad do the work. As a client it is their responsibilty to make sure that anyone working on there property is working safely. Alarm bells should of started ringing when PPE was not present.

Eh? If a client picks a stupidly cheap price from someone because they want bottom drawer prices, rather than work from a recommendation, then that is the client's risk.

However I don't see that it is the private client's role to check whether PPE is being worn, checking that safe systems of work are in place and risk assessments have been done. What next, client responsible for maintaining equipment?

Note - for e.g. utility and trackside work, I think the burden of responsibility is different. But for private customers, who the law would not expect to know what was going on, the arborist doing the contracting must lead the responsibility.
