I've had trees with well over the 5 cubic metre limit and still had them down.

 

I would rather ask the local tree officer if there is a TPO or conservation order in place as they are far more likely to prosecute.

I'm sure we've all dropped enough in a day's "garden tidying" to exceed the threshold. Like you say, the FC aren't likely to come out for a look unless someone kicks off (see my previous post).

 

I guess the hassle of prosecution is why they've decided to gain the ability to secure a restock order without prosecution.

Speak to your local FC officer, they are normally really helpfull. Our one has been known to fill in the licence applications for us in the past! They are there to help, not hinder. They are also giving out grants for re-stocking and allowing natural re-gen, so worth looking into that. Always worth a quick call to the council to make sure they are not tpo, and you are not in a conservation area, which the FC like to know. Would definatley not reccomend even starting the saw without the licence in place though, normally takes a max of 6 weeks to sort out.

I've not had grief personally, but there was a guy locally that was taken to court for doing exactly what you're talking about. He was told there was a licence in place, so he ended up with a fine, unlike the developer that had misled him, got a major fine and re-plant order. It still made him jack in treework though.

if so he knew from the start there was no licence in place. it was the local tree officer who ipped off the forestry commision.

Scott and co. are quite correct there is no legal defintion of a garden. If you used the garden as an angle you could argue a 500ha estate in scotland was a garden !

 

I've often said to the FC that a garden based tree removal situation is a failed crop and then re-stocking often isn't an issue.

 

The other issue to bear in mind is that if the FC and TO aren't interested the EA often is so to summarise get everything in place it isn't worth the rick Ben.

i worked with tim for about 4 years before he got done. he got warned about working for the land owner by a few people but thought he knew best. he ended up having a nervous breakdown.

he is gardening now for someone round windermere and working for a firewood merchant round kendal way most saturdays. the reasons well i'd say ignorance, money and wanting to prove people wrong.
