short question,could you be prosecuted for driving on fc land for no insurance,even though the police checked and found my car totally roadworthy ,no gates no signs .

If the land is generally accessible to the public and that includes private car parks etc then yes. Pretty sure FC land would be in that category.

If a road is open to the general public without restriction then the Road Traffic Act normally applies. In other words the vehicle must be road legal to use these 'private' roads. If you are driving 'off road' without permission then that is a separate offence that you can be prosecuted for and the vehicle confiscated.

I would have thought yes, you would be prosecuted as fc land is not private, ie it is not your private land and whether it was sign posted or not you surely would have had to have driven the vehicle to get there. Even to drive green lanes the vehicle has to have current MOT, tax and insurance.

Worth having a look at Police Reform Act 2002 (section 59) and Road Traffic Act 1988 (section 34).

A 'green lane' does not have any legal status for motor vehicles or otherwise. The only Rights of Way that have legal rights for motorised vehicles are Byways Open to All Traffic (BOATS).

why would you think that Forestry Commission land is not private just because the land is owned by the government does not mean it isn't private
