looking at going freelance. advice needed...

No employers liability covers sub contractors aslong as It specifies bonafide sun contractors?????????? I think.

 

Yes, no, yes, no.......

 

EL does not cover subcontractors cos you are not employing them, you are hiring their company.

 

PL should include the USE of bona fide sub contractors, BUT you would still want to make sure they have their own as they are out of your control (because they are on a seperate contract)

P/L doesn't cover subbies but you can get extra cover (which is worth it). And as rupe says it is down to the owner of the company if he/she hires someone who isnt up to the job the should lay on his sholders. on the other hand the problem is when other elements are in case and your insurance doesn't cover subbies and someone drives through traffic lights and gets hit by a falling branch or this is the first time you have taken someone on through list of tickets and experiance so it is hard to tell but accidents do happen. And subbies pl isnt much to fork out and always look good i think as it shows contractors that you care about what might happen.

So basically if I didn't quote for or do any of my own jobs and only went and climbed for other firms then I wouldn't need PL or EL insurance. Just some sort of tool cover?

 

I just typed a big reply and hit soemthing wrong and it went.

 

Basically Yes, that is how I see it, although others disagree no one can really come up with a reason to have it.

Thing is she was really shook up, a split second and it would have been through the windscreen and she could have been seriously hurt, yeah she was daft to drive under but if she wanted to take it further I would have been found at fault I am sure.

 

Yes, the fact that the branch landed in the carriagway where traffic was still continueing means it would be your fault. Even though she jumped the lights.

 

If you want to land stuff in the open carriageway you need to physically stop the traffic both ways (not just two red lights).

 

Hopefully she knows she was in the wrong though, but either way it can't ever be the climbers fault. team effort and all that. If he disobeyed your instrcutions then its yoru fault for hiring soemone that disobeyes instructions. There is no passing the buck.

EL does cover uninsured freelancers? My insurance company had a long discussion over this matter, I said i use Freelance climbers and sub contractors. I was told for using a sub contractor they would need there own PL as they would be undertaking the work, doing there own risk assessments. So i wouldn't, but freelancers work with you and under your supervision are classed as third party employed apparently. Well by your company so you do need EL but if they have there own PL you don't. So i didn't take EL and will only use insured PL contractors subby or freelance.

 

Thats what i was told by Trust.

Yeh my premiums have leveled out but they got me on the pl for sub-contractors (btw i use the subbies and freelancers in the same context sorry for confusion) and yes they seem to keep the insurance compnays profits up but i know one day i may need it and hopefully get back what i have put in the pot lol/.

This is true but i hire sub contractors as skilled workers able to work of their own back and lead teams and to hire a non skilled sub contractor would make my company un profitable and take on unskilled labor over a certain amount of hours per week makes sense to take them on paye anyway.
