My son has just bought some land which has trees on the boundary of the village. He was being hassled by a villager that a tree was unsafe so got a surgeon to investigate. Long story short, tree is now cut down. 

Turns out tree had a TPO. Should the tree surgeon have investigated? Should solicitors have flagged this up in sales contracts?

It also appears he has 11 trees with TPO but can only find 7!  What should he do?

If they were on his property the conveyance should have flagged it up. Until the council prosecute there is no loss. If they do prosecute and win then there may be a case against the conveyancer but  I don't think you can get compensation for the cost of a fine in a criminal offence.

 

He had the tree felled and ignorance is no defence so it will be  interesting if the council do get involved.
