Take a dictaphone, be clear concise and polite. See if you can catch them out on a recording.

 

Remember that any recording must be with their consent. To be honest, Martyn, you have such a good case under Contract law that you would be better off just taking them to court. My advice to you is to check with the CAB that what I told you about cashing the cheque is correct. If they confirm it then cash the cheque, let it clear and then sue for the balance plus your costs.

The recording would be for defense.

 

If they accused him of arrassment and intimidation he could prove to the investigating officer that he has been polite and curtious, the customer need not know they had been recorded and the officer would have to be very very anal to take it any further and would be grateful more police time hasn't been wasted

Any recording made without the knowledge and consent of all parties is inadmissable as evidence in court, and also a possible infringement of privacy rights. I know what you are saying re being a record of what Martyn says but for a confession from them, it would not be allowed.

I have a dictaphon and record any conversation that I think may warrant it. I couldn't care less about possible infringment :biggrin:

 

My mate saved himself from a jail sentence because of a malicious lie his wife told to the police when they broke up. She told them he said he was going to shoot her, he had firearms and she knew what a statement such as that would cause.

 

They arrested him, took his guns and treat him like a criminal. He recorded his next conversation with his wife. Inadmissable or not, it saved his butt.

 

I wouldn't hesitate butt covering with a dictaphone

I agree but you are confusing two things, mate.

 

1) Police enquiries and Court are two very different things.

 

2) Martyn's situation sits entirely in the Civil Court, not the Criminal, and so different standards of evidence apply.

I was replying to Martins enquiry of the possiblility of him being done for harrassment should he knock on the door everyday asking for his payment, the dictaphone would be his recording of his voice being polite and concise therefore protecting him from any malicous accusations
