  1. ? Indeed. But once a tree exists we must consider its value as is. There is no difference to my mind between a self-sown ash and a planted deodar. Valid reasons? Not relevent to amenity issues. There is a case for calling them 'protection' orders Benefits easily outweigh such issues. See my comments above on this catch 22. An competent individual appointed by the secetary of state deals with appeals. I think they would challenge that point. The guidance to reduce reliance on area orders predates this review. This review will not end their use. They are a valuable tool. Good point about accesibility. There are issues for the increasing integration of trees into the planning system and resulting complication. A dead TPO tree might be exempt in terms of removal. It is not exempt from a requirement to replant. Apologies if my statement seem abrupt. Its a concious decision to strip the point down.
  2. Hmmm. How'd you remove it? I mean its physically inside its host? If the tree's not infested or stressed why not leave it? MB - You guys got the same mistletoe? Viscum album? Its rare to see it implimented in tree death over here IMO
  3. Ha - I found out the other week that clouds are classified with 'genus', 'species' and 'varieties'. Odd. I would definately be rocking the MEWP. Did you rig any of it at all?

  6. Catch 22 though isn't it? Chap calls up, "I've got a veteran oak tree in my garden and I want to top it... Are there any constraints on my property?" There isn't. But after explaining the past thirty years of arb research he says "yeah... but its too tall, and there's no constraints so i'll top it anyway. Thanks. Bye..." What are the options? a)TPO the tree = maybe agree some sort of reduction? b) Do nothing = topped oak Results of either course of action? a) LPA accused of inappropriate tpo 5 years later when chap has moved. b) LPA accused of not protecting tree. Its all chess mate. Just moves in a game.

  8. A TPO is a charge on the land. If you do your pre-purchase homework. It is registered as a landcharge. If you owned a house with a TPO tree / trees in the garden. The law (and I would suggest common sense) requires that you know what the **** that involves. Ignorance is no defence in the eyes of the law. Your clients may well ask your for advice but they could do just as well conatcting the LPA who served the TPO.

  11. not with a TPO. If they haven't done their homework. Tough. Large investment or not. Whey should everyone loose the quality of local amenity just because some people can't be bothered to educate themselves. Bet they know the price of everything and the value of nothing.

  16. An extremely mature Bhutan Pine (Pinus wallichiana) that I literally tripped over the other day doing a survey. The limbs just disappear off into the undergrowth. I'm still trying to imagine what it must have been like before its decline. The local kids call it the 'octopus tree.'
  17. Fell 'em all. Replant with heavy standard suitable species. Cheaper in the long run. Having the right tree in the right place means that Ed will run out of trees to top!
  18. MonkeyD is the man. Aesculin found in in the fruit and sapwood/bark displays a natural fluorescence in water. You guys could have googled it just as easily!!!!
